Terms of Service

These Terms of Service ("Terms") govern your use of the dMaya platform and website at dmaya.ai (the "Service"), operated by Contemy Creatives Private Limited ("we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are using dMaya on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1. The Service

dMaya is an AI-powered design platform that lets you generate, iterate on, and export UI designs. The Service includes AI design generation, design system management, team collaboration, client preview sharing, and code export functionality.

dMaya is a design tool. It does not generate, deploy, or host functional applications. Designs exported from dMaya are provided as HTML, CSS, and Tailwind code intended as a starting point for development in external tools.

2. Accounts

You must create an account to use dMaya. You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account.

You must provide a valid email address. You must be at least 16 years old. You may not create an account on behalf of someone else without their permission. You may not create multiple accounts to circumvent usage limits or credit restrictions.

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if we reasonably believe your account poses a security risk.

3. Ownership of Your Designs

You own everything you create in dMaya. All designs, screens, components, design tokens, and exported code generated through your use of the Service belong to you. You have full commercial rights to use your designs for any purpose, including client work, internal projects, products, and resale.

By using the Service, you grant us a limited license to store, process, display, and transmit your design content solely for the purpose of providing the Service to you and your team. This includes displaying designs through preview links you choose to share, rendering screens on your canvas, and sending design context to AI model providers for generation and editing.

We do not claim ownership of your designs. We do not use your design content to train AI models. We do not display, sell, or distribute your designs except as necessary to provide the Service or as directed by you (such as through preview links you share).

4. AI-Generated Content

Designs created through dMaya are generated using third-party AI models (including models from Google and Anthropic) accessed through OpenRouter. The output of these models may not always be unique. It is possible that similar prompts by different users could produce visually similar results.

We do not guarantee that AI-generated designs are free from visual similarities to existing designs, brands, or copyrighted material. You are responsible for reviewing generated designs before using them commercially and ensuring they do not infringe on third-party intellectual property rights.

AI-generated designs are provided "as is." While we strive for high-quality output, the AI may produce unexpected results, errors, or content that does not match your intent. You are responsible for reviewing and approving all designs before presenting them to clients or using them in production.

5. Credits and Billing

Credit System

dMaya uses a credit-based system. Credits are consumed when you use AI features, including design generation, design editing, and chat interactions. The number of credits consumed per action varies based on the AI model you select. More powerful models consume more credits per action.

Subscription Plans

Paid plans are billed monthly or annually as selected at the time of purchase. Each plan includes a monthly credit allocation. Monthly plan credits expire at the end of each billing period and do not roll over. Annual plan credits roll over within the subscription year.

Top-Up Credits

Additional credits can be purchased as a top-up add-on to any active subscription. Top-up credits are not available without an active subscription. Top-up credits expire 4 months after purchase or when your active subscription ends, whichever comes later. Plan credits are consumed before top-up credits.

Refunds

Credits are non-refundable once consumed. If you cancel your subscription, you retain access to the Service and your remaining credits until the end of your current billing period. Unused credits from cancelled plans are forfeited at the end of the billing period.

We may offer refunds at our discretion for billing errors, service outages that materially affect your use, or other exceptional circumstances. Refund requests should be sent to hello@dmaya.ai.

Price Changes

We may change our pricing at any time. For existing subscribers, price changes take effect at the start of the next billing period. We will provide at least 30 days notice before any price increase takes effect.

6. Team Collaboration and Sharing

You can invite team members to your projects with specific roles (viewer, editor, or owner). You are responsible for managing access to your projects and for any actions taken by team members you invite.

Preview links allow anyone with the link to view design screens in a project without creating an account. You are responsible for controlling who you share preview links with. Preview link viewers can see the design screens but cannot edit, comment, or access your account information.

Comments left on projects are visible to all project members. You are responsible for the content of your comments.

7. Acceptable Use

You agree not to use dMaya to:

• Generate designs that violate any applicable law or regulation
• Create content that infringes on intellectual property rights of others
• Generate designs containing harmful, abusive, hateful, or illegal content
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms
• Use automated scripts, bots, or scraping to access the Service
• Circumvent credit limits, rate limits, or other usage restrictions
• Share your account credentials with others or allow unauthorized access
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to compete directly with dMaya by building a similar product

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines.

8. Code Export and External Use

Designs exported from dMaya are provided as HTML, CSS, and Tailwind code. This code is yours to use, modify, and integrate into any project or framework. We make no guarantees about the production-readiness, performance, accessibility compliance, or security of exported code.

You are responsible for reviewing, testing, and adapting exported code before deploying it in production environments. dMaya is a design tool, not a code generation or deployment platform. The exported code is a starting point for development, not a finished product.

9. Service Availability and Changes

dMaya is currently in early access. We may change, update, or discontinue features at any time. We aim to provide reliable service but do not guarantee uninterrupted availability.

We depend on third-party AI model providers to power design generation. Changes in the availability, pricing, or capabilities of these providers may affect the Service. We will make reasonable efforts to maintain service quality but are not liable for disruptions caused by third-party providers.

If we discontinue the Service entirely, we will provide at least 30 days notice and give you the opportunity to export your designs before shutdown.

10. Limitation of Liability

To the maximum extent permitted by law, dMaya and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

We are not liable for designs generated by AI models, including any intellectual property claims, inaccuracies, or suitability for your specific use case. You use AI-generated output at your own discretion and risk.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant that AI-generated designs will be unique, original, free from third-party IP claims, or suitable for any particular purpose.

12. Indemnification

You agree to indemnify and hold harmless dMaya and its team from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your design content, or your infringement of any third-party rights.

13. Termination

You can stop using dMaya at any time by cancelling your subscription through your account settings. Your access continues until the end of your current billing period.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or abusive activity, or if continuing your access would pose a risk to the Service or other users.

Upon termination, your right to use the Service ends. You should export any designs you want to keep before your access expires. We may delete your data 30 days after account termination unless retention is required by law.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes that affect your rights or obligations, we will provide notice through the Service or by email.

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service.
